What a first-time visitor sees is whichever their device says, by default. Somebody whose phone is in dark mode has already told it what they want, and asking again is a worse answer than acting on it.
Turn it on by itself adds a schedule: between two times, or from sunset to sunrise. Both are worked out in the reader's own browser, not on your server — so a reader in Sydney looking at a shop in Berlin gets dark when it is dark where they are. Give coordinates for sunset and sunrise if most of your readers are somewhere you know; leave them empty and it falls back to the device's own setting.
A schedule only decides for somebody who has not chosen. The moment a reader presses the switch, their choice wins and keeps winning.
Remembering is kept in the reader's own browser — not a cookie, so it never travels with a request and never reaches your server.
